1. Acceptance of Terms

By accessing or using Streamz ("the Service"), operated by Paragon Design ("we", "us", "our"), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Service.

2. Description of Service

Streamz is a streaming content discovery platform that aggregates publicly available information about movies, TV shows, and streaming service availability in New Zealand. We do not host, stream, or provide access to any video content. We are not a streaming service.

Streaming availability data is sourced from third-party providers including The Movie Database (TMDB) and may not always be accurate or up to date. We make no guarantees regarding the accuracy, completeness, or timeliness of this information.

3. Accounts & Registration

Certain features require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information and promptly update it if it changes.

We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent or abusive purposes.

4. Subscriptions & Payments

Streamz offers a free tier and a paid "Pro" subscription. Pro subscriptions are billed through Stripe on a recurring monthly or annual basis as selected at checkout.

• Subscription fees are charged in advance for each billing period.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are provided.
• We reserve the right to change subscription pricing with reasonable notice. Existing subscribers will be notified before any price increase takes effect on their next renewal.
• Free trial periods, if offered, automatically convert to a paid subscription unless cancelled before the trial ends.

5. Affiliate Links & Third-Party Services

The Service may contain links to third-party streaming platforms and services. Some of these links may be affiliate links, meaning we may earn a commission if you subscribe to or purchase from a third-party service after clicking through from Streamz.

These affiliate relationships do not influence our recommendations or the content we display. We are not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is governed by their respective terms and conditions.

6. Intellectual Property

All original content on Streamz, including but not limited to the design, code, logos, and text, is owned by Paragon Design and protected by applicable intellectual property laws.

Movie and TV show metadata, images, and related information are provided by TMDB and their respective rights holders. Streamz does not claim ownership of this third-party content.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these terms
• Attempt to gain unauthorised access to the Service, other accounts, or related systems
• Scrape, crawl, or use automated means to access the Service without our written consent
• Interfere with or disrupt the Service or servers connected to it
• Resell, redistribute, or commercially exploit the Service without authorisation

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that streaming availability information will be accurate or current.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, Paragon Design and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Paragon Design and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these terms.

11. Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated through the Service or via email. Continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.

13. Consumer Guarantees Act

Nothing in these terms is intended to limit any rights you may have under the Consumer Guarantees Act 1993 (NZ) or the Fair Trading Act 1986 (NZ) that cannot be lawfully excluded.
